VimWell Cancellation Policy of In-App Purchases

VimCoins are solely a type of digital content we offer as part of our Services. You agree and acknowledge that VimCoins have no monetary value and do not constitute or represent currency or property of any kind. You do not acquire any ownership rights in or to VimCoins or any digital content. You may collect VimCoins through our Services and optionally you may purchase extra amount of VimCoins through certain online payment systems. Within VimWell, you may exchange VimCoins for other digital content. You can read more about VimCoins in our Terms of Service.

You have to understand that you technically download VimCoins from our servers and that they do not have any identification code or similar. Once the download process is completed and the purchased amount of VimCoins has been assigned to your user account, you agree that the purchase of VimCoins is completed and ultimate. VimWello does not permit exchanges or refunds for any (including unused) VimCoins. The law of Austria requires us to inform you that you do have the usual EU consumer rights of withdrawal, but those do not subsist in this case because we start and finish providing you the purchased VimCoins within (and before the end of) the withdrawal period. In order to fulfill our legal obligations in the EU, we have to provide you these documents every time you initiate a purchase.

Information on exercising the right of withdrawal – Cancellation Policy

Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is of fourteen days from and including the day when the contract was concluded.

In order to exercise your right of withdrawal, you must send an unambiguous declaration (e.g. a letter sent by post, fax or email) to inform us (VimWello GmbH i.L., Am Hofacker 7A/1, 8010 Graz, Austria, support@vimwell.eu) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send the notification about your will to exercise your right of cancellation before the cancellation period has expired.

Consequences of the withdrawal

If you withdraw from this contract, we must give you back all payments that we have received from you, including the delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we received your notification of cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; in no case will you be charged any fees for this repayment.

Exception to the right of withdrawal

The consumer has no right of withdrawal for the delivery of digital content not stored on a physical data carrier if the entrepreneur - with the express consent of the consumer, combined with his knowledge of the loss of the right of withdrawal when the contract is fulfilled early and after provision of a copy or confirmation in accordance with Section 7 Paragraph 3 FAGG - has started the delivery before the otherwise existing withdrawal period has expired.

According to § 7 Paragraph 3 FAGG, the consumer will receive a confirmation of the concluded contract on a permanent data carrier (e.g. e-mail) together with the information specified in § 4 Paragraph 1 FAGG within a reasonable period after the conclusion of the contract, but at the latest before the start of the service provided, unless this information has already been made available on a permanent data carrier. In any case, the confirmation of the contract contains a confirmation of the consent to the immediate provision of the service and the consumer's knowledge of the resulting loss of the right of withdrawal.
